Denver’s Regional Transporation District is dealing with a lawsuit after a commuter practice crashed into and killed a bicyclist final yr.
The lawsuit was filed Thursday by Jacqueline Flores Razo after her husband, Juan, was killed in a crash with an RTD A-Line practice final July.
In response to the grievance, Flores Razo’s husband was using his bike by way of the crosswalk of RTD’s Havana Crossing mild rail station when a southbound practice turned off its lights for a northbound practice.
As soon as the northbound practice handed, the southbound practice continued by way of the station and crashed into Juan.
“The incident was brought on by the negligent, careless and reckless operation of the RTD practice,” the lawsuit acknowledged, including that the practice conductor “didn’t train warning and due care by, amongst different gadgets, failing to be attentive and correctly monitor the practice tracks.”
The lawsuit claims that the RTD practice conductor dedicated vehicular murder, reckless driving and careless driving.
Flores Razo is looking for compensation for financial damages — together with funeral and burial bills, cremation bills and the monetary burden of shedding her husband’s earnings — and non-economic damages — together with ache and struggling, emotional misery, lack of companionship and decreased high quality of life — in accordance with the lawsuit.
She can be asking RTD to pay her husband’s excellent medical payments from the crash.
RTD, the conductor, Denver Transit Companions and Fluor Enterprises are all named within the lawsuit.
