NEW YORK (Reuters) -Kroger sued the U.S. Federal Commerce Fee on Monday, searching for to dam the regulator from reviewing the grocery chain’s proposed $25 billion merger with smaller rival Albertsons in its in-house tribunal.
Kroger known as the tribunal unconstitutional, saying the matter needs to be resolved in a federal court docket.
The lawsuit filed in Cincinnati comes per week earlier than the corporate is scheduled to face a trial the place the FTC has requested a federal choose in Portland, Oregon, to briefly block the merger whereas its in-house judges evaluate the deal.
The FTC stated in a lawsuit filed in February that the deal will increase costs for hundreds of thousands of People and squeeze the labor marketplace for unionized grocery retailer staff.
That in-house evaluate may take years, Kroger stated within the lawsuit.
Kroger Chairman Rodney McMullen stated in an announcement that the corporate is “ready to defend this merger within the upcoming trial in federal court docket – the suitable venue for this matter to be heard.”
“We’re asking the court docket to halt what quantities to an illegal continuing earlier than the FTC’s personal in-house tribunal,” he stated.
A spokesperson for the FTC declined to remark.
